In July of 2021, President Biden directed the FTC to “curtail the unfair use of non-compete clauses . . . that may unfairly limit worker mobility.” On January 5, 2023, the FTC went further than expected by proposing a rule that would ban all employee non-compete agreements and invalidate employee non-compete agreements already signed.
